12、，數(shù)量： 臺(tái)。二、使用地點(diǎn)：十堰市經(jīng)濟(jì)技術(shù)開(kāi)發(fā)區(qū)方塊村甲方工地。三、設(shè)備用途：甲方工地土方工程施工。四、租賃方式：臺(tái)時(shí)租賃，柴油甲供。 五、租賃時(shí)間：根據(jù)甲方工程需要確定，退場(chǎng)時(shí)間以甲方通知為準(zhǔn)。六、租賃價(jià)格：租賃單價(jià)為 元/臺(tái)時(shí)，柴油由甲方供應(yīng)，乙方承擔(dān)租賃設(shè)備的折舊費(fèi)、各種修理費(fèi)、電費(fèi)、司機(jī)人工工資、其它油料費(fèi)用、設(shè)備進(jìn)退場(chǎng)費(fèi)等所有費(fèi)用，協(xié)議實(shí)施期間不調(diào)整單價(jià)。七、租賃條件1、租賃期間乙方設(shè)備因工作需要消耗的燃油由甲方供應(yīng)，因維修而發(fā)生的燃油由乙方自行承擔(dān)。2、設(shè)備的其它油料（如液壓油、機(jī)油、黃油、齒輪油等）由乙方自行承擔(dān)。3、租賃期間設(shè)備的維修費(fèi)用及配件費(fèi)用由乙方承擔(dān)。4、設(shè)備的調(diào)配使用

13、由甲方調(diào)度員協(xié)調(diào)安排，乙方應(yīng)服從甲方對(duì)設(shè)備工作的安排。5、乙方提供的設(shè)備狀況應(yīng)完好、手續(xù)齊全，燈光、儀表等裝置應(yīng)保持正常工作。乙方設(shè)備工作能力必須滿足要求，乙方設(shè)備應(yīng)配有技術(shù)熟練的操作人員，并且持有效操作證件，保證一個(gè)月最低工作240小時(shí)，否則按比例扣除租賃費(fèi)。操作人員必須遵守甲方規(guī)定的作息時(shí)間，不準(zhǔn)遲到、早退，服從現(xiàn)場(chǎng)施工人員的指揮。如設(shè)備性能或司機(jī)操作水平、素質(zhì)影響甲方工程進(jìn)度，或不服從甲方管理，甲方有權(quán)將司機(jī)或設(shè)備清退，乙方應(yīng)及時(shí)更換人員或設(shè)備，否則甲方有權(quán)終止協(xié)議，因此給甲方帶來(lái)的工程進(jìn)度損失由乙方負(fù)責(zé)。6、司機(jī)的食宿、水電費(fèi)用、工資、獎(jiǎng)金及其它福利待遇由乙方負(fù)責(zé)支付。7、乙方應(yīng)嚴(yán)格要

14、求己方人員，不得在項(xiàng)目部施工現(xiàn)場(chǎng)或生活營(yíng)區(qū)內(nèi)酗酒、賭博、滋事，如發(fā)現(xiàn)立即清退，如違法，將提交司法部門(mén)處理。8、若由于乙方人員、設(shè)備不服從甲方調(diào)度管理，影響甲方文明施工及當(dāng)?shù)卮迕窕虻谌叩纳a(chǎn)生活所產(chǎn)生的費(fèi)用由乙方全部承擔(dān)。9、若乙方不經(jīng)甲方允許，私自安排設(shè)備工作，發(fā)現(xiàn)一次罰款人民幣500元，并且賠償因此消耗的燃油費(fèi)用。10、未經(jīng)甲方同意，乙方不得隨意更換設(shè)備。替補(bǔ)的設(shè)備必須在原設(shè)備退場(chǎng)前進(jìn)場(chǎng)，且替補(bǔ)設(shè)備在性能、狀況等方面必須滿足本條款第5點(diǎn)的要求。11、乙方因設(shè)備檢修或其他特殊原因確需暫停作業(yè)的，應(yīng)提前一日向甲方提出書(shū)面申請(qǐng)，經(jīng)甲方批準(zhǔn)后方可暫停作業(yè)。12、稅金：營(yíng)業(yè)稅、城市建設(shè)維護(hù)稅和教育費(fèi)

15、附加由甲方承擔(dān)，其他稅費(fèi)由乙方自行繳納。13、在租賃期間設(shè)備的使用權(quán)屬甲方，租賃期間車(chē)輛除正常檢修外，乙方車(chē)輛應(yīng)停在甲方指定地點(diǎn)，應(yīng)做到隨用隨到。每個(gè)月不設(shè)定最高工作時(shí)限，每天不設(shè)定最高工作時(shí)限。在生產(chǎn)中應(yīng)發(fā)揮設(shè)備的正常功效（不能消極怠工），以滿足甲方的生產(chǎn)需要。八、甲方的權(quán)利和義務(wù)1、負(fù)責(zé)提供作業(yè)部位，安排乙方設(shè)備的工作。2、負(fù)責(zé)設(shè)備工作臺(tái)時(shí)的計(jì)量，及時(shí)為乙方辦理結(jié)算并支付。3、負(fù)責(zé)油料供應(yīng)。4、發(fā)現(xiàn)乙方現(xiàn)場(chǎng)人員偷賣(mài)柴油時(shí)，甲方有權(quán)處罰。并處以偷賣(mài)油料價(jià)款的5倍罰款，要求更換司機(jī)或終止協(xié)議。5、甲方對(duì)乙方設(shè)備油耗進(jìn)行測(cè)算（實(shí)測(cè)或設(shè)備臺(tái)時(shí)計(jì)算），油耗超過(guò)定額標(biāo)準(zhǔn)后（或乙方燃油被偷盜），費(fèi)用由乙

16、方自行承擔(dān)。在辦理租賃費(fèi)結(jié)算時(shí)，從乙方的結(jié)算款中扣除。九、乙方的權(quán)利和義務(wù) 1、乙方應(yīng)遵守甲方有關(guān)機(jī)械車(chē)輛和人員的管理規(guī)定，并服從甲方調(diào)度的生產(chǎn)安排。2、乙方現(xiàn)場(chǎng)人員應(yīng)遵守甲方有關(guān)文明施工的規(guī)定。3、乙方設(shè)備的操作人員應(yīng)持有有效操作證件。4、甲方違章指揮時(shí)，乙方有權(quán)拒絕。5、乙方人員的用餐費(fèi)、水電費(fèi)由乙方承擔(dān)。6、乙方設(shè)備需要供油，應(yīng)提前通知甲方油罐車(chē)，避免有效工作時(shí)間的損失。油罐車(chē)裝表計(jì)量，每次供油后，由乙方負(fù)責(zé)人員在油料供應(yīng)單據(jù)上簽字確認(rèn)。十、安全責(zé)任1、嚴(yán)格執(zhí)行機(jī)械使用安全技術(shù)操作規(guī)程和甲方下發(fā)的各項(xiàng)安全操作管理規(guī)程。尤其要確保設(shè)備操作人身安全。嚴(yán)格遵守施工現(xiàn)場(chǎng)交通規(guī)則，積極維護(hù)施工現(xiàn)場(chǎng)

17、交通秩序，保證施工現(xiàn)場(chǎng)道路的暢通和通行安全，不得亂停、亂靠，不得爭(zhēng)道搶行。2、施工過(guò)程中，非操作人員一律禁止進(jìn)入駕駛室。車(chē)輛在行駛中或尚未停穩(wěn)時(shí)，嚴(yán)禁任何人上、下車(chē)。司機(jī)不得酒駕及帶病作業(yè)。司機(jī)離開(kāi)設(shè)備必須將開(kāi)關(guān)鑰匙隨身帶走，如設(shè)備發(fā)生被盜或人為損壞，乙方自行負(fù)責(zé)。如乙方未按本協(xié)議約定的安全管理要求，或因乙方司機(jī)操作不當(dāng)和設(shè)備自身原因造成的安全事故由乙方承擔(dān)全部損失和費(fèi)用。造成人員傷亡或機(jī)械及其它財(cái)產(chǎn)損失的，由施工作業(yè)駕駛員和設(shè)備所有人承擔(dān)全部經(jīng)濟(jì)責(zé)任和相應(yīng)的法律責(zé)任，與甲方無(wú)關(guān)。3、乙方對(duì)其施工設(shè)備向保險(xiǎn)公司投保施工設(shè)備險(xiǎn)，所需費(fèi)用已包含在租賃單價(jià)中。出現(xiàn)意外事故后，乙方應(yīng)直接向保險(xiǎn)公司索賠

18、，甲方不承擔(dān)意外事故的任何賠償責(zé)任。4、乙方駕駛?cè)藛T人身意外傷害險(xiǎn)由甲方向保險(xiǎn)公司投保，出現(xiàn)人身意外傷亡事故后，乙方積極配合甲方向保險(xiǎn)公司索賠，保險(xiǎn)公司賠付與實(shí)際賠償差額部分由乙方承擔(dān)賠償。5、乙方駕駛?cè)藛T工傷險(xiǎn)由甲方向保險(xiǎn)公司投保，出現(xiàn)工傷事故后，乙方積極配合甲方向保險(xiǎn)公司索賠，保險(xiǎn)公司賠付與實(shí)際賠償差額部分由乙方承擔(dān)賠償。6、乙方必須無(wú)條件的接受甲方在安全上的監(jiān)督、管理及處罰，但這種安全上的監(jiān)督、管理及處罰并不能減輕和免除乙方在安全上應(yīng)承擔(dān)的責(zé)任和義務(wù)。7、因甲方指揮不當(dāng)造成的安全事故由甲方承擔(dān)全部損失和費(fèi)用。8、乙方車(chē)輛發(fā)生的交通事故由乙方自行與交警部門(mén)解決處理，并承擔(dān)一切費(fèi)用，與甲方無(wú)

19、關(guān)。十一、結(jié)算與支付1、計(jì)量：乙方設(shè)備工作時(shí)間，以雙方確認(rèn)的計(jì)量單為準(zhǔn)。如乙方不服從甲方指揮，或施工過(guò)程中不按甲方指令工作，該工作時(shí)間不予計(jì)量，乙方承擔(dān)責(zé)任并賠償該工作時(shí)間內(nèi)發(fā)生的燃油費(fèi)用。2、結(jié)算：結(jié)算日期以每月25日為界限，到結(jié)算日期時(shí)收齊單據(jù)，確認(rèn)為有效單據(jù)后，核實(shí)加油量、工作時(shí)間，辦理工程量?jī)r(jià)款結(jié)算，如有燃油超耗情況，則按協(xié)議約定扣除超耗燃油的費(fèi)用。3、價(jià)款支付：乙方需在甲方指定的銀行開(kāi)設(shè)銀行結(jié)算賬戶(hù)，甲方將工程款匯至乙方賬戶(hù)。十二、本協(xié)議未盡事宜，雙方友好協(xié)商解決。若協(xié)商不成，甲乙雙方均有權(quán)將合同爭(zhēng)議向甲方住所地人民法院提起訴訟。 十三、本協(xié)議由甲乙雙方代表簽字蓋章后生效，雙方履行完
