2、進(jìn)行指導(dǎo)、檢查和評(píng)估。 (三)向受聘方提供必要的工作和生活條件。 (四)配備合作共事人員。 (五)按時(shí)支付受聘方的報(bào)酬。 六、受聘方的義務(wù)： (一)遵守中國(guó)的法律、法規(guī)，不干預(yù)中國(guó)的內(nèi)部事務(wù)。 (二)遵守聘方的工作制度和有關(guān)外國(guó)專(zhuān)家的管理規(guī)定，接受聘方的工作安排、業(yè)務(wù)指導(dǎo)、檢查和評(píng)估。未經(jīng)聘方同意，不得兼職。 (三)按期完成工作任務(wù)，保證工作質(zhì)量。 (四)尊重中國(guó)的宗教政策。不從事與身份不符的活動(dòng)。 (五)尊重中國(guó)人民的道德規(guī)范和風(fēng)俗習(xí)慣。 七、合同的變更、解除和終止： 雙方應(yīng)信守合同，未經(jīng)雙方一致同意，任何一方不得擅自變更、解除和終止合同。 (一)合同的變更。經(jīng)當(dāng)事人雙方協(xié)商同意后，可以變更

3、。在未達(dá)成一致意見(jiàn)前，仍應(yīng)當(dāng)嚴(yán)格履行合同。 (二)合同的解除。經(jīng)當(dāng)事人雙方協(xié)商同意后，可以解除合同。在未達(dá)成一致意見(jiàn)前，仍應(yīng)當(dāng)嚴(yán)格履行合同。 1、聘方在下述條件下，有權(quán)以書(shū)面形式通知受聘方解除合同： (1)受聘方不履行合同或者履行合同義務(wù)不符合約定條件，經(jīng)聘方指出后，仍不改正的； (2)根據(jù)醫(yī)生診斷，受聘方在病假連續(xù)3 0天后不能恢復(fù)正常工作的。 2、受聘方在下述情況下，有權(quán)以書(shū)面形式通知聘方解除合同： (1)聘方未按合同約定提供受聘方必要的工作和生活條件； (2)聘方未按時(shí)支付受聘方報(bào)酬。 3、當(dāng)事人一方要求解除合同，應(yīng)提前3 0天以書(shū)面形式向另一方提出，3 0天以后方可解除合同。 4、雙方

4、協(xié)商一致，可以解除合同。 (三)合同的終止。 1、合同期滿(mǎn)該合同即告終止。 2、經(jīng)當(dāng)事人雙方協(xié)商同意后，也可以終止該合同。在未達(dá)成一致意見(jiàn)前，仍應(yīng)當(dāng)嚴(yán)格履行合同。 八、違約金： 當(dāng)事人一方不履行合同或者未完全履行合同所規(guī)定的義務(wù)，即為違反合同，應(yīng)當(dāng)向另一方支付8 0 03 0 O O美元或相當(dāng)于受聘方月工資3到1 0倍數(shù)額人民幣的違約金。如雙方認(rèn)為有必要約定確切數(shù)額或更高或更低的違約金，應(yīng)當(dāng)在合同附件中寫(xiě)明。 受聘方因不可抗力事件要求解除合同，需出具有關(guān)機(jī)構(gòu)證明。經(jīng)聘方同意解除合同后，受聘方離華的費(fèi)用自理；受聘方若無(wú)故解除合同，除離華費(fèi)用自理外，還應(yīng)當(dāng)向聘方支付違約金。 聘方因不可抗力事件要求

5、解除合同，經(jīng)受聘方同意解除合同后，受聘方離華費(fèi)用由聘方負(fù)擔(dān)；聘方若無(wú)故解除合同，除負(fù)擔(dān)受聘方離華費(fèi)用外，還應(yīng)當(dāng)向受聘方支付違約金。 九、本合同附件為合同不可分割的組成部分，與合同具有同等法律效力。 十、本合同自雙方簽字之日起生效，合同期滿(mǎn)即自行失效。當(dāng)事人一方要求簽訂新合同，應(yīng)當(dāng)在本合同期滿(mǎn)3 0天前向另一方提出，經(jīng)雙方協(xié)商一致同意后簽訂新的合同。 受聘方合同期滿(mǎn)后，在華逗留期間的一切費(fèi)用自理。 十一、合同爭(zhēng)議解決方式 當(dāng)事人雙方發(fā)生合同爭(zhēng)議時(shí)，盡可能通過(guò)協(xié)商或者調(diào)解解決。若協(xié)商、調(diào)解無(wú)效，可向當(dāng)?shù)厝耸禄騽趧?dòng)仲裁機(jī)構(gòu)申請(qǐng)仲裁。對(duì)仲裁結(jié)果不服的，可向人民法院提起訴訟。 本合同于 年 月 日在 簽

19、either party fails to fulfill any part or all of the obligations as stipulated in this contract, that is，in the event of breach of the contract，the said party shall pay a breach penalty of US$800 to 3000 or equivalent to 3 to 10 times Party BS monthly salary in RMBIf both parties consider it necessa

20、ry to determine an exact sum of the breach penalty，or to determine a breach penalty higher or lower than the abovementioned amountit shall be explicated in the appendix of this contractWhen Party B claims to cancel this contract due to force majeureit shall produce certifying documents issued by com

21、petent authorities；after the contract is cancelled with Party AS consent，Party B shall bear the traveling expenses thus incurred；and when Party B fails to provide any valid reason to cancel this contractIt shall bear the traveling expenses thus incurred and pay the breach penalty to Party A as stipu

22、lated in this contractWhen Party A claims to cancel this contract due to force majeure，and the contract is thus cancelled with Party B consentit shall bear Party BS traveling expenses thus incurred；and when Party A fails to provide any valid reason to cancel this contractit shall bear the traveling

23、expenses thus incurred to Party B and pay the breach penalty to Party B as stipulated in this contractIXThe appendix of this contract forms an indispensable part of this contract and shall have the same legal effect with the text of this contractXThis contract shall take effect upon being signed by

24、both parties and shall be automatically terminated upon expirationWhen either party requires signing a renewed contract，it shall forwardits request to the other party 30 days prior to the expiration of this contract，and both parties shall sign the new contract through consultations and mutual consen
