_BF20080603 合同編號:北京市房屋租賃合同HOUSES LEASE CONTRACT(自行成交版)(No Broker Version)出租人Lessor: 承租人Lessee: 北京市建設(shè)委員會Beijing Construction Committee北京市工商行政管理局Beijing Administration for Industry and Commerce二八年五月修訂Amendment in May,2008北京市房屋租賃合同BeijingHouses Lease Contract(自行成交版)(No Broker Version)出租人(甲方)Lessor (Party A): 證件類型及編號Credential type and NO.: 承租人(乙方)Lessee (Party B): 證件類型及編號 Credential type and NO.: 依據(jù)中華人民共和國合同法及有關(guān)法律、法規(guī)的規(guī)定,甲乙雙方在平等、自愿的基礎(chǔ)上,就房屋租賃的有關(guān)事宜達(dá)成協(xié)議如下:Based on the Contract Law Of the Peoples Republic of China and other relevant regulations and laws, and with the intermediary services ofParty C, Party A and Party B agree to enter into this Contract in equal status and voluntarily with articles as follow:第一條 房屋基本情況 Article 1: General states of the house(一)房屋坐落于北京市 區(qū)(縣) 街道辦事處(鄉(xiāng)鎮(zhèn)) ,建筑面積 平方米。(a) The house is located at (Address), and the size is Square meters.(二)房屋權(quán)屬狀況:甲方持有 (房屋所有權(quán)證/ 公有住房租賃合同/ 房屋買賣合同/ 其他房屋來源證明文件),房屋所有權(quán)證書編號: 或房屋來源證明名稱: ,房屋所有權(quán)人(公有住房承租人、購房人)姓名或名稱: ,房屋(是 / 否) 已設(shè)定了抵押。(b)The condition of the house property rights: party A has (Muniment/Public houses lease contract/Houses Purchase Contract /Other certificate), the munimentNO.: , or the certificate of obtaining the house: , House-ownersname (Public houses lessee or house buyer): ,Whether the house has been mortgaged (YES/NO).第二條 房屋租賃情況及登記備案 Article 2: Rental situation and registration(一)租賃用途: ;如租賃用途為居住的,居住人數(shù)為: ,最多不超過 人。(a) Rental purposes: If the rental purpose is for residence, the number of inhabitant is , and should not exceeding persons.(二)如租賃用途為居住的,甲方應(yīng)自與乙方訂立本合同之日起7日內(nèi),到房屋所在地的社區(qū)來京人員和出租房屋服務(wù)站辦理房屋出租登記手續(xù)。對多人居住的,乙方應(yīng)將居住人員情況告知甲方,甲方應(yīng)建立居住人員登記簿,并按規(guī)定報送服務(wù)站。本合同變更或者終止的,甲方應(yīng)自合同變更或者終止之日起5日內(nèi),到房屋所在地的社區(qū)來京人員和出租房屋服務(wù)站辦理登記變更、注銷手續(xù)。在本合同有效期內(nèi),居住人員發(fā)生變更的,乙方應(yīng)當(dāng)自變更之日起2日內(nèi)告知服務(wù)站,辦理變更登記手續(xù)。居住人員中有外地來京人員的,甲方應(yīng)提供相關(guān)證明,督促和協(xié)助乙方到當(dāng)?shù)毓才沙鏊k理暫住證;居住人員中有境外人員的,(甲方 /乙方)應(yīng)自訂立本合同之時起24小時內(nèi)到當(dāng)?shù)毓才沙鏊k理住宿登記手續(xù)。租賃用途為非居住的,甲方應(yīng)自訂立房屋租賃合同之日起30日內(nèi),到房屋所在地的房屋行政管理部門辦理房屋租賃合同備案手續(xù)。If the rental purposes is for residence, from the date when this Contract has been set up, within 7 days, Party A should go to the Community Service Station for Foreigner and House Lease (hereinafter refers to as the “station”) to have the house lease contract registered. If the inhabitant is more than one person, Party B must inform the situation of inhabitants to Party A. On the other hand, Party A must establish a register for inhabitants, and send it to the Station complying with regulation. If this contract has been amended or terminated, party A should go to the Station to change or logout the registration within 5 days. In the period of validity, provided the inhabitants have changed, from the date of change, within 2 days, Party B must inform the Service Station and change the registration.Party A should supply the related information about himself and/or the house if there is foreigner from other provinces within the inhabitant, to assist and supervise Party B to handle the Temporary Residential Permit at Local Police Station. And Party B should go to Local police station to handle the Lodging Registration within 24 hours if there is any person from other countries, from the time when this contract has been set up.If the rental purpose is not residence, from the date when this contract has been set up, within 30 days, Party A should go to the department of Local House Administration to handle the Lease Contract Registration filing procedure.第三條 租賃期限 Article 3:Lease Term(一)房屋租賃期自 年 月 日至 年 月 日,共計 年 個月。甲方應(yīng)于 年 月 日前將房屋按約定條件交付給乙方。房屋交割清單(見附件一)經(jīng)甲乙雙方交驗簽字蓋章并移交房門鑰匙及 后視為交付完成。(a) From the date / / to / / totally months. After Party A and Party B had signed and sealed the“Property list” (appendix 1), and Party A had delivered the key of the house and to Party B, the house have been delivered.(二)租賃期滿或合同解除后,甲方有權(quán)收回房屋,乙方應(yīng)按照原狀返還房屋及其附屬物品、設(shè)備設(shè)施。甲乙雙方應(yīng)對房屋和附屬物品、設(shè)備設(shè)施及水電使用等情況進(jìn)行驗收,結(jié)清各自應(yīng)當(dāng)承擔(dān)的費用。乙方繼續(xù)承租的,應(yīng)提前 30 日向甲方提出(書面 / 口頭)續(xù)租要求,協(xié)商一致后雙方重新簽訂房屋租賃合同。(b) Party A has the right to retract the house upon the expiration of the leasehold or the dissolution of the contract, and, Party B should return the leased house and accessary facilities in original state to Party A. Both parties must check and accept the house and the accessory facilities, meanwhile, settle accounts of the cost which should be bore by their own.If the Lessee intends to renew the leasehold, should notify (written/oral) the Lessor within one month before termination. The deposit shall be refundable after its expiration or early termination, deducting the expense which Party B owed and the amends for any loss of unusual damage.第五條 其他相關(guān)費用的承擔(dān)方式 Article 5: Other fees租賃期內(nèi)的下列費用中, 由甲方承擔(dān), 由乙方承擔(dān):(1)水費(2)電費(3)電話費(4)電視收視費(5)供暖費(6)燃?xì)赓M(7)物業(yè)管理費(8)房屋租賃稅費(9)衛(wèi)生費(10)上網(wǎng)費(11)車位費(12)室內(nèi)設(shè)施維修費(13) 費用。During the lease term, Party B should bear fees that Party A should bear fees that (a) Water fee(b) Electrical bill(c) Telephone bill(d) TV expense of television reception(e) Heating expense(f) gas expense(g) Property management fee(h) Housing rental taxes(i) Health costs(j) Internet expense(k) Parking fees(l) Indoor facilities maintenance costs(m) others本合同中未列明的與房屋有關(guān)的其他費用均由甲方承擔(dān)。如乙方墊付了應(yīng)由甲方支付的費用,甲方應(yīng)根據(jù)乙方出示的相關(guān)繳費憑據(jù)向乙方返還相應(yīng)費用。The Party A should bear other fees which this contract has not listed which concern the house. If the Party B had paid the fees related proof, Party A should returned corresponding fees to Party B.第六條 房屋維護(hù)及維修 Article 6: Maintenance and repair(一)甲方應(yīng)保證房屋的建筑結(jié)構(gòu)和設(shè)備設(shè)施符合建筑、消防、治安、衛(wèi)生等方面的安全條件,不得危及人身安全;承租人保證遵守國家、北京市的法律法規(guī)規(guī)定以及房屋所在小區(qū)的物業(yè)管理規(guī)約。(a) Party A should ensure that the construction and facilities of rental house is conformed to relevant laws and regulations. Party B could not do any unlawful or illegal activities which are not allowed according to the State laws, the government regulations and the local byelaw. In the period of rents, both parties should keep the house, the facilities and goods attached to the house in safe and suitable.(二)租賃期內(nèi),甲乙雙方應(yīng)共同保障房屋及其附屬物品、設(shè)備設(shè)施處于適用和安全的狀態(tài):(b)In the period of rents, both parties should keep the house, the good and facilities attached to the house in applicable and safe:1、對于房屋及其附屬物品、設(shè)備設(shè)施因自然屬性或合理使用而導(dǎo)致的損耗,乙方應(yīng)及時通知甲方修復(fù)。甲方應(yīng)在接到乙方通知后的 7 日內(nèi)進(jìn)行維修。逾期不維修的,乙方可代為維修,費用由甲方承擔(dān)。因維修房屋影響乙方使用的,應(yīng)相應(yīng)減少租金或延長租賃期限。aParty B should notice Party A about any damage of the houses due to poor quality, natural tear and wear or calamities. Party A should be responsible for repairing in 7 days and bear the expenses. Provided Party A has not repaired on schedule, Party B could repair instead of Part A. Party A should bear the expenses which should be undertaken by himself. Once the repairing has made an impact on the usual life, Party A should reduce rental or extend the period of rent correspondingly.2、因乙方保管不當(dāng)或不合理使用,致使房屋及其附屬物品、設(shè)備設(shè)施發(fā)生損壞或故障的,乙方應(yīng)負(fù)責(zé)維修或承擔(dān)賠償責(zé)任。bThe damage of the premises or the fittings that is within the control of the party B should be borne by party B.第七條 轉(zhuǎn)租 Article 7: Transfer or Sublet除甲乙雙方另有約定以外,乙方需事先征得甲方書面同意,方可在租賃期內(nèi)將房屋部分或全部轉(zhuǎn)租給他人,并就受轉(zhuǎn)租人的行為向甲方承擔(dān)責(zé)任。Party B should not partly or totally sublet without the written permission from party A. If the house has been transferred or sublet, Party B should be liable for compensating for any behavior of sublet person.第八條 合同解除 Article 8: Dissolution of Contract(一)經(jīng)甲乙雙方協(xié)商一致,可以解除本合同。(a) The contract can be rescind based on the agreement(二)因不可抗力導(dǎo)致本合同無法繼續(xù)履行的,本合同自行解除。(b) If Force Majeure cause to terminating the contract, the contract is rescinded.(三)甲方有下列情形之一的,乙方有權(quán)單方解除合同:(c) If Party A has one of the following behaviors, Party B has the right to rescind this Contract unilaterally.1、遲延交付房屋達(dá) 7 日的。a Within 7 days, Party A has not turn over the house.2、交付的房屋嚴(yán)重不符合合同約定或影響乙方安全、健康的。b The house does not conform to the contract seriously or affects the safety and healthy of Party B.3、不承擔(dān)約定的維修義務(wù),致使乙方無法正常使用房屋的。c Because Party A has not repaired house, Party B could not use house normally.4、 。d (四)乙方有下列情形之一的,甲方有權(quán)單方解除合同,收回房屋:(d) If Party B has one of the following behaviors, Party A has the right to rescind the Contract unilaterally and take back the house.1、不按照約定支付租金達(dá) 日的。a If Party B delays rental payment in the excess of _days.2、欠繳各項費用達(dá) 元的。b If Party B delays kinds of fees in the excess of _yuan.3、擅自改變房屋用途的。c If Party B changes the use of the leased house unilaterally.4、擅自拆改變動或損壞房屋主體結(jié)構(gòu)的。d If Party B changes or damages the main structure of house unilaterally.5、保管不當(dāng)或不合理使用導(dǎo)致附屬物品、設(shè)備設(shè)施損壞并拒不賠償?shù)摹 The damage of the premises or the fittings that is within the control of party B and party B refuses to compensate.6、利用房屋從事違法活動、損害公共利益或者妨礙他人正常工作、生活的。f The Party Bs behaviors in the house are unlawful or interfere with other peoples life.7、擅自將房屋轉(zhuǎn)租給第三人的。g The Party B transfer or sublet the leased house unilaterally.8、 。 h (五)其他法定的合同解除情形。(e) Other legal situations of contract rescission.第九條 違約責(zé)任 Article 9: Responsibility for breach of the Contract(一)甲方有第八條第三款約定的情形之一的,應(yīng)按月租金的 200 %向乙方支付違約金;乙方有第八條第四款約定的情形之一的,應(yīng)按月租金的 200 %向甲方支付違約金,甲方并可要求乙方將房屋恢復(fù)原狀或賠償相應(yīng)損失。(a) Either of Parties behaviors results in the termination of the contract before its expiration, the penalty for breach should be 200% of monthly rental . Party A has the right to take back the premises and take actions against party Bs breach.(二)租賃期內(nèi),甲方需提前收回房屋的,或乙方需提前退租的,應(yīng)提前 30 日通知對方,并按月租金的 200 %向?qū)Ψ街Ц哆`約金;甲方還應(yīng)退還相應(yīng)的租金。(b) In the period of rent, either Party A shall take back the house ahead, or Party B shall return the house before the contract expiration, he should informed the other party ahead of 30 days. Tort-feasor agrees that the penalty for breach of contract shall be 200% of monthly rental. At the same time, Party A should return the surplus rent.(三)因甲方未按約定履行維修義務(wù)造成乙方人身、財產(chǎn)損失的,甲方應(yīng)承擔(dān)賠償責(zé)任。(c) Party A has not repaired the house in time according to the contract, so Party Bs security has been damaged. Party A should undertake the liability of compensation.(四)甲方未按約定時間交付房屋或者乙方不按約定支付租金但未達(dá)到解除合同條件的,以及乙方未按約定時間返還房屋的,應(yīng)按 日租金的200% 標(biāo)準(zhǔn)支付違約金。(d) Having not rescinded the Contract, but tort-feasor agree that the penalty for breach of Contract shall be 200% of daily rental surpasses one day.a Party A shall not turn over the houses on schedule to Party B for use.b Party B shall not pay the rental on schedule according to the provisions of the Contract.c Party B shall not return the house on schedule according to the provisions of the Contract.(五) 。(e) 第十條 合同爭議的解決辦法 Article 10: Headling of disputes本合同項下發(fā)生的爭議,由雙方當(dāng)事人協(xié)商解決;協(xié)商不成的,依法向有管轄權(quán)的人民法院起訴,或按照另行達(dá)成的仲裁條款或仲裁協(xié)議申請仲裁。(a) Any dispute arising from the execution of, or in connection with, the contract shall be settled through friendly negotiation between parties. In case no settlement can be reached, the disputes shall be submitted to the peoples court, which has jurisdiction over the houses. Or compelled arbitration in accordance with the arbitration clause or the arbitration agreement.(b) This contract will be governed by and construed under the laws of the Peoples Republic of China.第十一條 其他約定事項 Article 11: Other matters 。本合同經(jīng)雙方簽字蓋章后生效。本合同(及附件)一式 份,其中甲方執(zhí) 份,乙方執(zhí) 份, 執(zhí) 份。This contract will be effective after being signed by both parties. There are 2 originals of this contract. Every party will hold 1 original(s).
