為了加強(qiáng)安全生產(chǎn)培訓(xùn)管理，規(guī)范安全生產(chǎn)培訓(xùn)秩序，保證安全生產(chǎn)培訓(xùn)質(zhì)量，促進(jìn)安全生產(chǎn)培訓(xùn)工作健康發(fā)展，根據(jù)安全生產(chǎn)法和有關(guān)法律、行政法規(guī)的規(guī)定，制定本辦法。 第二條 安全培訓(xùn)機(jī)構(gòu)、生產(chǎn)經(jīng)營(yíng)單位從事安全生產(chǎn)培訓(xùn)(以下統(tǒng)稱安全培訓(xùn))活動(dòng)以及安全生產(chǎn)監(jiān)督管理部門、煤礦安全監(jiān)察機(jī)構(gòu)對(duì)安全培訓(xùn)工作實(shí)施監(jiān)督管理，適用本辦法。 法律、行政法規(guī)和國(guó)務(wù)院另有規(guī)定的，從其規(guī)定。 第三條 本辦法所稱安全培訓(xùn)是指以提高安全監(jiān)管監(jiān)察人員、生產(chǎn)經(jīng)營(yíng)單位從業(yè)人員和從事安全生產(chǎn)工作的相關(guān)人員的安全素質(zhì)為目的的教育培訓(xùn)活動(dòng)。 前款所稱安全監(jiān)管監(jiān)察人員是指縣級(jí)以上人民政府安全生產(chǎn)監(jiān)督管理部門、各級(jí)煤礦安全監(jiān)察機(jī)構(gòu)從事安全監(jiān)督監(jiān)察、行政執(zhí)法的安全生產(chǎn)監(jiān)察員和煤礦安全監(jiān)察員;生產(chǎn)經(jīng)營(yíng)單位從業(yè)人員是指生產(chǎn)經(jīng)營(yíng)單位主要負(fù)責(zé)人、安全生產(chǎn)管理人員、特種作業(yè)人員及其他從業(yè)人員;從事安全生產(chǎn)工作的相關(guān)人員是指從事安全教育培訓(xùn)工作的教師、危險(xiǎn)化學(xué)品的登記人員和承擔(dān)安全評(píng)價(jià)、咨詢、檢測(cè)、檢驗(yàn)的人員及注冊(cè)安全工程師等。 第四條 安全培訓(xùn)工作實(shí)行統(tǒng)一規(guī)劃、歸口管理、分級(jí)實(shí)施、分類指導(dǎo)、教考分離的原則。 國(guó)家安全生產(chǎn)監(jiān)督管理局(國(guó)家煤礦安全監(jiān)察局)(以下統(tǒng)稱國(guó)家局)指導(dǎo)全國(guó)安全培訓(xùn)工作，依法對(duì)全國(guó)的安全培訓(xùn)工作實(shí)施監(jiān)督管理。 省、自治區(qū)、直轄市安全生產(chǎn)監(jiān)督管理部門依法對(duì)本行政區(qū)域內(nèi)的安全培訓(xùn)工作實(shí)施監(jiān)督管理。 設(shè)立煤礦安全監(jiān)察機(jī)構(gòu)的省、自治區(qū)、直轄市，由省級(jí)煤礦安全監(jiān)察機(jī)構(gòu)依法對(duì)所轄區(qū)域內(nèi)煤礦企業(yè)的安全培訓(xùn)工作實(shí)施監(jiān)督管理。 第二章 安全培訓(xùn)機(jī)構(gòu) 第五條 安全培訓(xùn)機(jī)構(gòu)從事安全培訓(xùn)活動(dòng)，必須取得相應(yīng)的資質(zhì)證書。資質(zhì)證書分四個(gè)等級(jí)。 一級(jí)、二級(jí)資質(zhì)證書，由國(guó)家局審批、頒發(fā);三級(jí)、四級(jí)資質(zhì)證書，由省、自治區(qū)、直轄市安全生產(chǎn)監(jiān)督管理部門審批、頒發(fā)。 設(shè)立煤礦安全監(jiān)察機(jī)構(gòu)的省、自治區(qū)、直轄市，由省級(jí)煤礦安全監(jiān)察機(jī)構(gòu)負(fù)責(zé)所轄區(qū)域內(nèi)從事煤礦安全培訓(xùn)活動(dòng)的培訓(xùn)機(jī)構(gòu)三級(jí)、四級(jí)資質(zhì)證書的審批、頒發(fā)。 第六條 取得一級(jí)資質(zhì)證書的安全培訓(xùn)機(jī)構(gòu)，可以承擔(dān)省級(jí)以上安全生產(chǎn)監(jiān)督管理部門、煤礦安全監(jiān)察機(jī)構(gòu)的安全生產(chǎn)監(jiān)察員、煤礦安全監(jiān)察員;中央企業(yè)的總公司、總廠或者集團(tuán)公司的生產(chǎn)經(jīng)營(yíng)單位的主要負(fù)責(zé)人和安全生產(chǎn)管理人員;危險(xiǎn)化學(xué)品登記人員;承擔(dān)安全評(píng)價(jià)、咨詢、檢測(cè)、檢驗(yàn)工作的人員;注冊(cè)安全工程師和一級(jí)以下安全培訓(xùn)機(jī)構(gòu)教師的培訓(xùn)工作。 取得二級(jí)資質(zhì)證書的安全培訓(xùn)機(jī)構(gòu)，可以承擔(dān)市、縣級(jí)安全生產(chǎn)監(jiān)督管理部門的安全生產(chǎn)監(jiān)察員;省屬生產(chǎn)經(jīng)營(yíng)單位和中央企業(yè)的分公司、子公司及其所屬單位的主要負(fù)責(zé)人和安全生產(chǎn)管理人員;危險(xiǎn)化學(xué)品登記人員;承擔(dān)安全評(píng)價(jià)、咨詢、檢測(cè)、檢驗(yàn)工作的人員;注冊(cè)安全工程師和二級(jí)以下安全培訓(xùn)機(jī)構(gòu)教師的培訓(xùn)工作。 取得三級(jí)資質(zhì)證書的安全培訓(xùn)機(jī)構(gòu)，可以承擔(dān)特種作業(yè)人員;市(地)屬生產(chǎn)經(jīng)營(yíng)單位的主要負(fù)責(zé)人、安全生產(chǎn)管理人員的培訓(xùn)工作。 取得四級(jí)資質(zhì)證書的安全培訓(xùn)機(jī)構(gòu)，可以承擔(dān)除本條第一款、第二款、第三款以外的生產(chǎn)經(jīng)營(yíng)單位從業(yè)人員的培訓(xùn)工作。 上一級(jí)安全培訓(xùn)機(jī)構(gòu)可以承擔(dān)下一級(jí)安全培訓(xùn)機(jī)構(gòu)的培訓(xùn)工作。 第七條 安全培訓(xùn)機(jī)構(gòu)申請(qǐng)一級(jí)資質(zhì)證書，應(yīng)當(dāng)具備下列條件： (一)注冊(cè)資金或者開(kāi)辦費(fèi)100萬(wàn)元以上; (二)有專職的管理人員; (三)有健全的機(jī)構(gòu)章程、管理制度、工作規(guī)則; (四)有15名以上具有本科以上學(xué)歷的專職或者兼職教師，其中至少有8名具有副高級(jí)以上職稱并且經(jīng)國(guó)家局培訓(xùn)考核合格的專職教師; (五)有固定、獨(dú)立和相對(duì)集中并且能夠滿足同期100人以上規(guī)模培訓(xùn)需要的教學(xué)及生活設(shè)施，其中專用教室使用面積150平方米以上; (六)安全培訓(xùn)需要的其他條件。 第八條 安全培訓(xùn)機(jī)構(gòu)申請(qǐng)二級(jí)資質(zhì)證書，應(yīng)當(dāng)具備下列條件： (一)注冊(cè)資金或者開(kāi)辦費(fèi)80萬(wàn)元以上; (二)有專職的管理人員; (三)有健全的機(jī)構(gòu)章程、管理制度、工作規(guī)則; (四)有10名以上具有本科以上學(xué)歷的專職或者兼職教師，其中至少有5名具有中級(jí)以上職稱并且經(jīng)國(guó)家局培訓(xùn)考核合格的專職教師; (五)有固定、獨(dú)立和相對(duì)集中并且能夠滿足同期80人以上規(guī)模培訓(xùn)需要的教學(xué)及生活設(shè)施，其中專用教室使用面積120平方米以上; (六)安全培訓(xùn)需要的其他條件。 第九條 安全培訓(xùn)機(jī)構(gòu)申請(qǐng)三級(jí)資質(zhì)證書，應(yīng)當(dāng)具備下列條件： (一)注冊(cè)資金或者開(kāi)辦費(fèi)50萬(wàn)元以上; (二)有專職或者兼職的管理人員; (三)有健全的機(jī)構(gòu)章程、管理制度、工作規(guī)則; (四)有8名以上具有本科以上學(xué)歷的專職或者兼職教師，其中至少有5名具有中級(jí)以上職稱并且經(jīng)省、自治區(qū)、直轄市安全生產(chǎn)監(jiān)督管理部門或者省級(jí)煤礦安全監(jiān)察機(jī)構(gòu)培訓(xùn)考核合格的專職教師; (五)有能夠滿足同期50人以上規(guī)模培訓(xùn)需要的教學(xué)及生活設(shè)施，其中專用教室使用面積100平方米以上; (六)安全培訓(xùn)需要的其他條件。 第十條 安全培訓(xùn)機(jī)構(gòu)申請(qǐng)四級(jí)資質(zhì)證書，應(yīng)當(dāng)具備下列條件： (一)注冊(cè)資金或者開(kāi)辦費(fèi)30萬(wàn)元以上; (二)有專職或者兼職的管理人員; (三)有健全的機(jī)構(gòu)章程、管理制度、工作規(guī)則; (四)有5名以上具有本科以上學(xué)歷的專職或者兼職教師，其中至少有3名具有中級(jí)以上職稱并且經(jīng)省、自治區(qū)、直轄市安全生產(chǎn)監(jiān)督管理部門或者省級(jí)煤礦安全監(jiān)察機(jī)構(gòu)培訓(xùn)考核合格的專職教師; (五)有能夠滿足同期30人以上規(guī)模培訓(xùn)需要的教學(xué)及生活設(shè)施，其中專用教室使用面積60平方米以上。 第十一條 申請(qǐng)一、二級(jí)資質(zhì)證書，按照下列程序辦理： (一)具備資質(zhì)條件的申請(qǐng)人將安全培訓(xùn)機(jī)構(gòu)資質(zhì)申請(qǐng)書、安全培訓(xùn)機(jī)構(gòu)設(shè)置批準(zhǔn)文件或者企事業(yè)單位法人登記證和本辦法第七條、第八條規(guī)定的材料報(bào)國(guó)家局; (二)國(guó)家局自受理申請(qǐng)之日起20日內(nèi)完成審查工作。符合條件的，頒發(fā)相應(yīng)的資質(zhì)證書;不符合條件的，書面通知申請(qǐng)單位并說(shuō)明理由。 第十二條 申請(qǐng)三、四級(jí)資質(zhì)證書，按照下列程序辦理： (一)具備資質(zhì)條件的申請(qǐng)人將安全培訓(xùn)機(jī)構(gòu)資質(zhì)申請(qǐng)書、安全培訓(xùn)機(jī)構(gòu)設(shè)置批準(zhǔn)文件或者企事業(yè)單位法人登記證和本辦法第九條、第十條規(guī)定的材料報(bào)省、自治區(qū)、直轄市安全生產(chǎn)監(jiān)督管理部門或者省級(jí)煤礦安全監(jiān)察機(jī)構(gòu); (二)省、自治區(qū)、直轄市安全生產(chǎn)監(jiān)督管理部門或者省級(jí)煤礦安全監(jiān)察機(jī)構(gòu)應(yīng)當(dāng)自受理申請(qǐng)之日起20日內(nèi)完成審查工作。符合條件的，頒發(fā)相應(yīng)的資質(zhì)證書，并報(bào)國(guó)家局備案;不符合條件的，書面通知申請(qǐng)單位并說(shuō)明理由。 第十三條 安全培訓(xùn)機(jī)構(gòu)的教師應(yīng)當(dāng)接受專門的培訓(xùn)，經(jīng)考核合格后，方可上崗執(zhí)教。 第十四條 安全培訓(xùn)機(jī)構(gòu)資質(zhì)證書不得出借、出租給其他機(jī)構(gòu)或者個(gè)人。 安全培訓(xùn)機(jī)構(gòu)資質(zhì)證書的有效期為3年。安全培訓(xùn)機(jī)構(gòu)資質(zhì)證書有效期滿需要延期的，應(yīng)當(dāng)于安全培訓(xùn)機(jī)構(gòu)資質(zhì)證書有效期滿前30日內(nèi)向原頒發(fā)證書的機(jī)構(gòu)辦理延期手續(xù)。 第十五條 對(duì)安全培訓(xùn)機(jī)構(gòu)及其教師的考核發(fā)證，不得收取任何費(fèi)用。 第三章 安全培訓(xùn) 第十六條 安全培訓(xùn)應(yīng)當(dāng)按照國(guó)家局、省級(jí)安全生產(chǎn)監(jiān)督管理部門統(tǒng)一制定的安全培訓(xùn)大綱進(jìn)行。 安全監(jiān)督監(jiān)察人員、危險(xiǎn)物品的生產(chǎn)、經(jīng)營(yíng)、儲(chǔ)存單位與礦山企業(yè)的主要負(fù)責(zé)人、安全生產(chǎn)管理人員和特種作業(yè)人員及從事安全生產(chǎn)工作的相關(guān)人員的安全培訓(xùn)大綱，由國(guó)家局組織制定。 除危險(xiǎn)物品的生產(chǎn)、經(jīng)營(yíng)、儲(chǔ)存單位和礦山企業(yè)以外其他生產(chǎn)經(jīng)營(yíng)單位的主要負(fù)責(zé)人、安全生產(chǎn)管理人員及其他從業(yè)人員的安全培訓(xùn)大綱，由省級(jí)安全生產(chǎn)監(jiān)督管理部門組織制定。 第十七條 國(guó)家局、省級(jí)安全生產(chǎn)監(jiān)督管理部門每2年組織一次優(yōu)秀教材的評(píng)選。 安全培訓(xùn)機(jī)構(gòu)應(yīng)當(dāng)優(yōu)先使用優(yōu)秀教材。 第十八條 國(guó)家局負(fù)責(zé)省級(jí)以上安全生產(chǎn)監(jiān)督管理部門的安全生產(chǎn)監(jiān)察員、各級(jí)煤礦安全監(jiān)察機(jī)構(gòu)的煤礦安全監(jiān)察員的培訓(xùn)工作;組織、指導(dǎo)和監(jiān)督中央企業(yè)的總公司、總廠、集團(tuán)公司的生產(chǎn)經(jīng)營(yíng)單位的主要負(fù)責(zé)人和安全生產(chǎn)管理人員的培訓(xùn)工作。 省級(jí)安全生產(chǎn)監(jiān)督管理部門負(fù)責(zé)市級(jí)、縣級(jí)安全生產(chǎn)監(jiān)督管理部門的安全生產(chǎn)監(jiān)察員的培訓(xùn)工作;組織、指導(dǎo)和監(jiān)督省屬生產(chǎn)經(jīng)營(yíng)單位、所轄區(qū)域內(nèi)中央企業(yè)的分公司、子公司及其所屬單位的主要負(fù)責(zé)人和安全生產(chǎn)管理人員的培訓(xùn)工作;組織、指導(dǎo)和監(jiān)督特種作業(yè)人員的培訓(xùn)工作。 市級(jí)、縣級(jí)安全生產(chǎn)監(jiān)督管理部門組織、指導(dǎo)和監(jiān)督本行政區(qū)域內(nèi)除中央企業(yè)、省屬生產(chǎn)經(jīng)營(yíng)單位以外的其他生產(chǎn)經(jīng)營(yíng)單位的主要負(fù)責(zé)人和安全生產(chǎn)管理人員的培訓(xùn)工作。 省級(jí)煤礦安全監(jiān)察機(jī)構(gòu)組織、指導(dǎo)和監(jiān)督所轄區(qū)域內(nèi)煤礦企業(yè)的主要負(fù)責(zé)人、安全生產(chǎn)管理人員和特種作業(yè)人員的培訓(xùn)工作。 危險(xiǎn)化學(xué)品登記人員和承擔(dān)安全評(píng)價(jià)、咨詢、檢測(cè)、檢驗(yàn)的人員及注冊(cè)安全工程師的安全培訓(xùn)按有關(guān)法律、法規(guī)、規(guī)章的規(guī)定進(jìn)行。 除主要負(fù)責(zé)人、安全生產(chǎn)管理人員、特種作業(yè)人員以外的生產(chǎn)經(jīng)營(yíng)單位的從業(yè)人員的安全培訓(xùn)，由生產(chǎn)經(jīng)營(yíng)單位負(fù)責(zé)。 第十九條 生產(chǎn)經(jīng)營(yíng)單位應(yīng)當(dāng)對(duì)從業(yè)人員進(jìn)行與其所從事崗位相應(yīng)的安全教育培訓(xùn);從業(yè)人員調(diào)整工作崗位或采用新工藝、新技術(shù)、新設(shè)備、新材料的，應(yīng)當(dāng)對(duì)其進(jìn)行專門的安全教育和培訓(xùn)。未經(jīng)安全教育和培訓(xùn)合格的從業(yè)人員，不得上崗作業(yè)。 第二十條 安全培訓(xùn)機(jī)構(gòu)從事安全培訓(xùn)工作的收費(fèi)，應(yīng)當(dāng)符合法律、法規(guī)的規(guī)定。法律、法規(guī)沒(méi)有規(guī)定的，應(yīng)當(dāng)按照行業(yè)自律標(biāo)準(zhǔn)或者指導(dǎo)性標(biāo)準(zhǔn)收費(fèi)。 第四章 安全培訓(xùn)的考核 第二十一條 安全培訓(xùn)的考核應(yīng)堅(jiān)持教考分離、統(tǒng)一標(biāo)準(zhǔn)、分級(jí)負(fù)責(zé)。 第二十二條 安全監(jiān)督監(jiān)察人員、危險(xiǎn)物品的生產(chǎn)、經(jīng)營(yíng)、儲(chǔ)存單位及礦山企業(yè)主要負(fù)責(zé)人、安全生產(chǎn)管理人員和特種作業(yè)人員的考核標(biāo)準(zhǔn)，由國(guó)家局制定。 除危險(xiǎn)物品的生產(chǎn)、經(jīng)營(yíng)、儲(chǔ)存單位和礦山企業(yè)以外其他生產(chǎn)經(jīng)營(yíng)單位主要負(fù)責(zé)人、安全生產(chǎn)管理人員及其他從業(yè)人員的考核標(biāo)準(zhǔn)，由省級(jí)安全生產(chǎn)監(jiān)督管理部門制定。 第二十三條 國(guó)家局負(fù)責(zé)省級(jí)以上安全生產(chǎn)監(jiān)督管理部門的安全生產(chǎn)監(jiān)察員、各級(jí)煤礦安全監(jiān)察機(jī)構(gòu)的煤礦安全監(jiān)察員的考核;負(fù)責(zé)中央企業(yè)的總公司、總廠、集團(tuán)公司的主要負(fù)責(zé)人和安全生產(chǎn)管理人員的考核。 省級(jí)安全生產(chǎn)監(jiān)督管理部門負(fù)責(zé)市級(jí)、縣級(jí)安全生產(chǎn)監(jiān)督管理部門的安全生產(chǎn)監(jiān)察員的考核;負(fù)責(zé)省屬生產(chǎn)經(jīng)營(yíng)單位和中央企業(yè)分公司、子公司及其所屬單位的主要負(fù)責(zé)人和安全生產(chǎn)管理人員的考核;負(fù)責(zé)特種作業(yè)人員的考核。 市級(jí)、縣級(jí)安全生產(chǎn)監(jiān)督管理部門負(fù)責(zé)本行政區(qū)域內(nèi)除中央企業(yè)、省屬生產(chǎn)經(jīng)營(yíng)單位以外的其他生產(chǎn)經(jīng)營(yíng)單位的主要負(fù)責(zé)人和安全生產(chǎn)管理人員的考核。 省級(jí)煤礦安全監(jiān)察機(jī)構(gòu)負(fù)責(zé)所轄區(qū)域內(nèi)煤礦企業(yè)的主要負(fù)責(zé)人、安全生產(chǎn)管理人員和特種作業(yè)人員的考核。 除主要負(fù)責(zé)人、安全生產(chǎn)管理人員、特種作業(yè)人員以外的生產(chǎn)經(jīng)營(yíng)單位的其他從業(yè)人員的考核，由生產(chǎn)經(jīng)營(yíng)單位負(fù)責(zé)。 第二十四條 安全生產(chǎn)監(jiān)督管理部門、煤礦安全監(jiān)察機(jī)構(gòu)和生產(chǎn)經(jīng)營(yíng)單位應(yīng)當(dāng)制定安全培訓(xùn)的考核制度，建立考核管理檔案。 第五章 安全培訓(xùn)的發(fā)證 第二十五條 接受安全培訓(xùn)人員經(jīng)考核合格的，由考核部門頒發(fā)相應(yīng)的證書。 第二十六條 安全生產(chǎn)監(jiān)察員經(jīng)考核合格后，頒發(fā)安全生產(chǎn)監(jiān)察員證;煤礦安全監(jiān)察員經(jīng)考核合格后，頒發(fā)煤礦安全監(jiān)察員證;危險(xiǎn)物品的生產(chǎn)、經(jīng)營(yíng)、儲(chǔ)存單位和礦山企業(yè)主要負(fù)責(zé)人、安全生產(chǎn)管理人員經(jīng)考核合格后，頒發(fā)安全資格證;特種作業(yè)人員經(jīng)考核合格后，頒發(fā)特種作業(yè)操作資格證(含IC卡);危險(xiǎn)化學(xué)品登記人員經(jīng)考核合格后，頒發(fā)上崗證;其他人員經(jīng)考核合格后，頒發(fā)培訓(xùn)合格證。 第二十七條 安全生產(chǎn)監(jiān)察員證、煤礦安全監(jiān)察員證、安全資格證、特種作業(yè)操作資格證(含IC卡)和上崗證的式樣，由國(guó)家局統(tǒng)一規(guī)定。培訓(xùn)合格證的式樣，由負(fù)責(zé)培訓(xùn)考核的部門規(guī)定。 第二十八條 安全生產(chǎn)監(jiān)察員證、煤礦安全監(jiān)察員證、安全資格證的有效期為3年。安全生產(chǎn)監(jiān)察員證、煤礦安全監(jiān)察員證、安全資格證的有效期滿需要延期的，應(yīng)當(dāng)于期滿前2個(gè)月內(nèi)向原發(fā)證部門辦理延期手續(xù)。 特種作業(yè)操作資格證的有效期為6年，每2年復(fù)審一次。特種作業(yè)操作資格證需延期或者復(fù)審的，應(yīng)當(dāng)于期滿前1個(gè)月內(nèi)向原發(fā)證部門或者異地相關(guān)部門辦理延期或者復(fù)審手續(xù)。復(fù)審內(nèi)容包括責(zé)任事故記錄、違法違章記錄、參加培訓(xùn)記錄等。復(fù)審不合格的，經(jīng)重新安全培訓(xùn)考核合格后，辦理延期手續(xù)。 個(gè)人在特種作業(yè)操作資格證有效期內(nèi)，連續(xù)從事本工種10年以上，嚴(yán)格遵守有關(guān)安全生產(chǎn)的法律法規(guī)的，在特種作業(yè)操作資格證的有效期滿時(shí)，經(jīng)原發(fā)證部門或者異地相關(guān)部門同意，不再?gòu)?fù)審，特種作業(yè)操作資格證的有效期延長(zhǎng)2年。 第二十九條 安全生產(chǎn)監(jiān)督管理部門、煤礦安全監(jiān)察機(jī)構(gòu)及其工作人員應(yīng)當(dāng)堅(jiān)持公開(kāi)、公平、公正的原則，嚴(yán)格按照法律、行政法規(guī)和本辦法的規(guī)定審查、頒發(fā)安全培訓(xùn)機(jī)構(gòu)的資質(zhì)證書。 對(duì)已經(jīng)取得資質(zhì)證書的安全培訓(xùn)機(jī)構(gòu)，安全生產(chǎn)監(jiān)督管理部門、煤礦安全監(jiān)察機(jī)構(gòu)應(yīng)當(dāng)每3年進(jìn)行一次評(píng)估檢查。 安全生產(chǎn)監(jiān)督管理部門、煤礦安全監(jiān)察機(jī)構(gòu)應(yīng)當(dāng)定期向社會(huì)公布已經(jīng)取得資質(zhì)證書的安全培訓(xùn)機(jī)構(gòu)名單，接受社會(huì)監(jiān)督。 第三十二條 安全生產(chǎn)監(jiān)督管理部門、煤礦安全監(jiān)察機(jī)構(gòu)應(yīng)當(dāng)對(duì)安全培訓(xùn)機(jī)構(gòu)開(kāi)展安全培訓(xùn)活動(dòng)的情況進(jìn)行監(jiān)督。 任何單位或者個(gè)人對(duì)安全培訓(xùn)機(jī)構(gòu)的違法違紀(jì)行為，均有權(quán)向安全生產(chǎn)監(jiān)督管理部門、煤礦安全監(jiān)察機(jī)構(gòu)報(bào)告或者舉報(bào)。 第三十三條 安全生產(chǎn)監(jiān)督管理部門、煤礦安全監(jiān)察機(jī)構(gòu)應(yīng)當(dāng)對(duì)生產(chǎn)經(jīng)營(yíng)單位主要負(fù)責(zé)人、安全生產(chǎn)管理人員、特種作業(yè)人員及其他從業(yè)人員的安全培訓(xùn)和持證上崗情況進(jìn)行監(jiān)督檢查。 第三十四條 監(jiān)察機(jī)關(guān)依照行政監(jiān)察法等法律、行政法規(guī)的規(guī)定，對(duì)安全生產(chǎn)監(jiān)督管理部門、煤礦安全監(jiān)察機(jī)構(gòu)及其工作履行安全培訓(xùn)工作監(jiān)督管理職責(zé)實(shí)施監(jiān)察。 第七章 罰則 第三十五條 安全生產(chǎn)監(jiān)督管理部門、煤礦安全監(jiān)察機(jī)構(gòu)工作人員在安全培訓(xùn)監(jiān)督管理工作中濫用職權(quán)、玩忽職守、徇私舞弊的，依照有關(guān)規(guī)定給予行政處分;構(gòu)成犯罪的，依法追究刑事責(zé)任。 第三十六條 安全培訓(xùn)機(jī)構(gòu)有下列情形之一的，責(zé)令限期改正;逾期未改正的，給予警告，并處10000元以下罰款;情節(jié)嚴(yán)重，有違法所得的，處以不超過(guò)違法所得3倍的罰款，但最高不得超過(guò)30000元，暫扣或者吊銷相應(yīng)的資質(zhì)證書;沒(méi)有違法所得的，暫扣或者吊銷相應(yīng)的資質(zhì)證書： (一)未按照統(tǒng)一的培訓(xùn)大綱組織教學(xué)培訓(xùn)的; (二)專職教師未經(jīng)考核，或者考核不合格而從事安全培訓(xùn)工作的; (三)將安全培訓(xùn)資質(zhì)證書出借、出租給其他機(jī)構(gòu)或者個(gè)人的。 安全培訓(xùn)機(jī)構(gòu)未取得資質(zhì)證書擅自從事安全培訓(xùn)活動(dòng)的，按照前款規(guī)定處罰。 第三十七條 安全培訓(xùn)機(jī)構(gòu)評(píng)估檢查不合格繼續(xù)從事安全培訓(xùn)活動(dòng)的，給予警告，并處10000元以下罰款;情節(jié)嚴(yán)重，有違法所得的，處以不超過(guò)違法所得3倍的罰款，但最高不得超過(guò)30000元，暫扣或者吊銷相應(yīng)的資質(zhì)證書;沒(méi)有違法所得的，暫扣或者吊銷相應(yīng)的資質(zhì)證書。 第三十八條 生產(chǎn)經(jīng)營(yíng)單位有下列情形之一的，責(zé)令限期改正;逾期未改正的，責(zé)令停產(chǎn)停業(yè)整頓，可以并處20000元以下的罰款： (一)危險(xiǎn)物品的生產(chǎn)、經(jīng)營(yíng)、儲(chǔ)存單位和礦山企業(yè)的主要負(fù)責(zé)人、安全生產(chǎn)管理人員未按規(guī)定考核合格取得安全資格證書的; (二)從業(yè)人員上崗作業(yè)前或采用新工藝、新技術(shù)、新材料、新設(shè)備前，未經(jīng)安全生產(chǎn)教育培訓(xùn)的;
