發(fā)價(jià)人 對(duì)接受人所提出的是一項(xiàng)內(nèi)容完整 明確 肯定的交易條件 一旦送達(dá)受盤人 即接受人或稱受發(fā)價(jià)人 之后 則對(duì)發(fā)盤人產(chǎn)生拘束力 發(fā)盤人在實(shí)盤規(guī)定的有效期內(nèi)不得將其撤銷或加以變更 表明發(fā)盤人有肯定訂立合同的意圖 如果受盤人在有效期內(nèi)無條件地接受 就可以達(dá)成交易 成為對(duì)買賣雙方都有約束力的合同 實(shí)盤必須同時(shí)具備三個(gè)條件才能成立 內(nèi)容必須是完整和明確的 內(nèi)容必須是肯定的 無保留條件的 實(shí)盤必須規(guī)定有效期限 其內(nèi)容包括貨物品名 品質(zhì)規(guī)格 包裝 數(shù)量 價(jià)格等
